Far from being a closed issue and a dead end, the battle over Cala Finanza continues, both inside and outside the courtrooms. On the sidelines of today's hearing before the administrative judges of Cagliari, a crucially important fact emerged regarding the case's developments: Tavolara Bay appears to have no intention of relinquishing its grip on the SEZ.
The Regional Administrative Court (TAR) was called upon to rule on the Region's appeal against the State's decisions. According to the regional council's lawyers, the Meloni government authorized the Cala Finanza developments (greenlighting the Fasano Al Mare Beach Club), bypassing the prerogatives of Sardinia's Special Statute. The permits contained in the single ZES authorization were issued and then withdrawn by the Department for the South, but the Region still wants a ruling , and the case has been adjourned until February. But there is another reason for the lengthy delay in the administrative proceedings.
The judges learned, albeit informally, that Tavolara Bay (represented by attorney Gian Comita Ragnedda and Professor Marcello Clarich) will certainly appeal the revocation of the SEZ. Therefore, the dispute has not been resolved; Tavolara Bay believes it has been severely damaged by a measure (the government's revocation of the permits for the glamping and beach club) that it deems to be unfounded. The company's lawyers, when contacted, declined to discuss today's hearing or comment. However, the documents reveal that the Sardinian-Brazilian company considers the revocation of the SEZ to be wrongful and illegitimate. Therefore, the dispute with the Region, at least regarding the SEZ, remains ongoing, as does the potential conflict of jurisdiction between the Region and the State.
