Andrea Giuntoli, the Santa Giusta worker accused of shooting his fellow villager Francesco Salis to death, was sentenced to 15 years plus three years of probation.
The sentence was read a few minutes ago by the judge of the Oristano Court, Serena Corrias, who did not recognise the mitigating circumstances and also sentenced Giuntoli to a 500 euro fine, to pay the legal costs and to a provisional sum of 50 thousand euros for the two brothers and the sister of the victim (civil parties with the lawyers Fabio Costa and Luciano Rubattu ).
Prosecutor Lorenzo Cosseddu had requested an 11-year sentence.
Immediately after the sentencing, defense attorneys Patrizio Rovelli and Marina Caria admitted some disappointment at the failure to recognize mitigating circumstances and self-defense, and the reclassification of the crime as manslaughter. They announced they will appeal.
On the other hand, the civil lawyers Rubattu and Costa expressed great satisfaction precisely because the mitigating circumstances were not recognized and their position was accepted.
The murder occurred on the night of August 9, 2024, after an evening spent at a local bar. There was apparently some friction because Salis had not appreciated Giuntoli's attention to his niece. Then the rendezvous on Via Dante: the young woman showed up with her uncle (who had meanwhile taken a billhook from his car) and another friend, while Giuntoli waited outside his Giulietta.
Salis allegedly shouted his rival's name while brandishing the billhook, and Giuntoli immediately fired. He then returned to his home, where he was shortly thereafter approached by the Carabinieri, to whom he admitted to shooting Salis. He was arrested immediately, but the bricklayer was found guilty.
