A twist in the trial for the murder of Toni Cozzolino, the 49-year-old from Olbia who was burned alive in the street on 11 March 2022 by his neighbour, Davide Iannelli, and died in hospital after ten days of agony. This morning, surprisingly, the accused did not show up in court , sending a document declaring his refusal to be subjected to the examination, scheduled for today, requesting that the trial continue in his absence.

«The absence of the accused must not be interpreted as a refusal to appear. In reality, our client is not in the right psychophysical health conditions to undergo the exam", said the lawyer Abele Cherchi, who, together with his colleague Cristina Cherchi, defends Iannelli. «I reiterate that we have a psychiatric report in progress which says that the accused has a clear borderline personality disorder. From the moment of his arrest until today he has been subjected to psychotropic drug therapy, which has only varied by increasing the doses administered - he adds - We, the defenders ourselves, have great difficulty in interfacing with him. I repeat that Iannelli is not well." Among the reasons, the lawyers say, is also the fact that for some time he has had no news of his wife, Rosa Bechere , who has been missing for a year and a half.

An interpretation contested by the prosecutor, Daniele Rosa, and by the civil party lawyers, Giampaolo Murrighile, Antonio Fois and Massimo Perra : «I have the impression that it is a procedural strategy - said the deputy prosecutor of Tempio Pausania - The accused so far he attended all the hearings and is not coming to this one. There is no medical certificate on his health condition. His refusal must be interpreted as an explicit refusal to undergo examination." The Court, presided over by Judge Massimo Zaniboni, adjourned the hearing until March 26, to hear the first six defense witnesses.
