"The available evidence does not at all support a finding of serious criminal responsibility on the part of the suspects. They did not contribute to the successful outcome of the murder."

This is the main reason why the Court of Review annulled the order of the Cagliari preliminary investigations judge who had ordered the pre-trial detention of Roberto and Sergio Arzu (Sandro's brothers), his nephew Gianluca, and Pier Giorgio Piras, from Arzana. The DDA and the Lanusei Prosecutor's Office consider them to be the alleged accomplices of Sandro Arzu, who committed suicide in prison on the night between June 8th and 9th, in the murder of Beniamino "Mino" Marongiu, 52, killed in Piazza Roma in Arzana on July 9th a year ago.

The order focuses on what happened in and around Piazza Roma in the minutes before and after the murder and on the roles of Arzu and Piras.

"There is no factual evidence," the judges wrote, "regarding the communication from supervisors Roberto and Sergio Arzu to Gianluca Arzu regarding the presence of the designated victim (Mino Marongiu) in the One bar."
