No to detention of migrants in Albania, the second group also returns to Italy

The Visalli ship arrived at the port of Brindisi around half past midnight with the seven migrants on board who had been in the Gjdaer centre in Albania since last Friday. Their return to Italy follows the decision of the Rome court that suspended the measure validating their detention, placing everything in the hands of the European Court of Justice.
The migrants, of Bangladeshi and Egyptian origin, were taken by minibus to a facility for asylum seekers. Here they will be able to follow the ordinary procedure for examining their application.
In the rooms of the Italian center in Gjader, therefore, also the second group of migrants does not remain more than two days: as already happened for the first twelve, also the seven new asylum seekers were transferred back to Italy. This time the immigration section of the court of Rome, faced with the recent decree on safe countries, suspends the judgment on the validation of their detention, leaving everything in the hands of the European Court of Justice.
The update of the list of countries of origin of migrants considered "safe", elevated to primary law after the first rejection by the judges last month, has therefore not had the effects hoped for by the government, calling into question the mechanism of accelerated repatriations .
Deputy Prime Minister Salvini has launched his accusations against the magistrates: "It is another political ruling against Italians and their safety. The government and Parliament have the right to react to protect citizens, and they will do so," attacks the Lega leader. For the National Association of Magistrates, however, the new Italian law is "incompatible with European Union law" and in case of doubt it was necessary to "raise a preliminary reference." The Ministry of the Interior, for its part, will appear before the European Court of Justice to support its reasons, but the time required to resolve the issue is expected to be long.
All eyes are now on December 4th when the Court of Cassation will have to rule on whether judges can act autonomously or whether they must adhere to the list of safe countries drawn up by the government.
On the opposition front, the Democratic Party speaks of "a disgraceful figure on the part of the government, which shows that with forcing and tricks to get around the law you don't get anywhere. The only effect is to condemn exhausted people, who come to Europe to escape violence and discrimination, to new exhausting journeys and transfers. A cruel and shameful choice that is also causing enormous damage to the state budget", claims the Democratic deputy, Debora Serracchiani, who adds: "The Rome court has applied the law impeccably that cannot ignore European legislation". And at Palazzo Madama, the group leader of Italia Viva, Enrico Borghi, asks that the Minister of the Interior report to the Senate "and explain what is happening. We - he adds - have policemen who control nothing in Albanian land while they should be here in Italy controlling public order in front of schools and in the streets".
