The Florence DDA has asked the investigating judge to shelve the investigation into the disaster of the Moby Prince , the ferry bound for Olbia that caught fire on 10 April 1991, after colliding with the oil tanker Agip Abruzzo in front of the port of Livorno, causing 140 deaths, including 26 Sardinians.

This was reported today by the Livorno prosecutor Maurizio Agnello, at the beginning of the hearing before the parliamentary commission of inquiry - the third - on the massacre, chaired by Pietro Pittalis.

Agnello explained that, since the Moby disaster occurred almost 34 years ago, only the intentional form of massacre remains as a criminal hypothesis . In fact, all negligent crimes would be time-barred .

«It would therefore be necessary to demonstrate, for the purposes of the existence of the crime of massacre, that someone intentionally acted in order to cause the death of 140 people outside of a context of subversive terrorism or mafia crime, in relation to which the Florence DDA has already investigated, which recently, as certainly reported by the prosecutor Spiezia, has requested the investigating judge to archive that proceeding».

Regarding the Livorno prosecutor's office, Agnello explained that it is currently "examining the conclusions that the delegated judicial police, the Guardia di Finanza of Florence, has submitted in a report of over 1,400 pages on which, I believe, my colleague Spiezia has already reported."

The prosecutor also specified that given the "too many dark points" revealed in the investigations by the Guardia di Finanza report, "if we were to be convinced that someone's conduct was among the causes of this disaster, we will not fail to indicate it to the preliminary investigations judge, however we will have no choice but to surrender to the fact that 34 years have now passed" .
