No to dismissal and yes to forced indictment for manslaughter in the Gesam case . Yesterday in court in Sassari, investigating judge Giuseppe Grotteria ordered that prosecutor Maria Paola Asara reformulate the charges against the three suspects in the death of Antonio Masia, a worker who died on July 25, 2022, at the Truncu Reale waste disposal facility , within ten days.

The magistrate had requested the dismissal of the cases against Antonio Cesaraccio, the company's president, Innocenzo Giannasi, a company manager, and Michela Coppola, the safety manager . In recent months, the judge had requested a further investigation into their case, into what happened three years ago, asking Spresal to determine whether any violations of workplace accident regulations had occurred at the plant. The same facility had also been severely damaged in the fire in August 2022, less than two weeks after Masia's death.

Several violations regarding accidents were found, thus suggesting that Masia's death could also be linked to this aspect.

Now the prosecutor will have to quickly reformulate the charges, as written, and this will lead to the preliminary hearing.

Francesca Fiori and Daniele Alicicco, the civil lawyers representing the deceased operator's family, opposed the dismissal of both the investigation into the three and the acquittal, "for not having committed the crime," decided by preliminary hearing judge Sergio De Luca last March against Fabiano Mario Saba, Masia's colleague, who was facing charges of manslaughter and concealment of a corpse.

The cause of death has been cited as "crushing trauma," possibly caused by one of the facility's vehicles. Attorney Nicola Lucchi is representing Cesaraccio and Coppola, while Giorgio Murino is representing Giannasi.
