The TAR says yes to 24,500 photovoltaic panels overlooking the nuragic palace of Barumini. The small municipality of Marmilla lost the appeal before the administrative judges, on whose territory one of the symbolic monuments of Sardinia stands. On the other side there was the Presidency of the Council of Ministers, brought before the court together with the Ministry of the Environment: big shots of the State who defended the validity of the "decree of 27 March 2023, with which the Director General of Environmental Assessments of The Ministry of the Environment and Energy Security has expressed a positive opinion on the environmental compatibility of the project proposed by Ss Ele II Srl, for the construction of an agro-photovoltaic plant called "Green and Blue Serra Tuili" with a power of 15,190 MW, of dimensions totaling approximately 24 hectares". The plan is for the locality Guranu, in the territory of Tuili, but not far from the palace discovered by Giovanni Lilliu.
The hopes of being able to block the project were placed in the constraint, with the declaration of "particular archaeological interest" of the Turriga nuraghe, which stands 230 meters away from where the expanse of panels would be placed. The provision from the regional Cultural Heritage commission of the Ministry of Culture arrived in October 2023. But it is not enough, due to a technicality.
Because the Way had already ended positively. And what's more, the nuraghe stands on private land. According to the TAR, the nuraghe is «therefore subject to the provisions of the Code of Cultural Heritage only from the moment in which the measure was adopted, having a constitutive nature due to private and not public property and, therefore, at the moment of the adoption of the final measure of the Street, this asset could not be considered an asset protected by the Code, with consequent suitability of the area ex lege for the installation of the system".
Twenty-four hectares of glass and silicon panels are blessed by the TAR. Subject to further appeals.
