A complicated birth at twenty-seven weeks, a caesarean section with suffering for mother and newborn . Then the transfer from San Martino in Oristano to the hospital in Sassari, where the little boy's heart stopped after just two hours of life. A tragedy for a young couple of parents from Terralba who, having overcome the pain, asked for justice.
The consultants of the Civil Court of Oristano have thus recognized the medical negligence and, thanks to the mediation of the lawyers Fabio Costa and Marco Emilio Mascia , an agreement was reached by virtue of which the insurance company Reale Mutua has recognized compensation of 810 thousand euros to the mother, now 36 years old, and to the father, who is six years younger.
THE FACTS – It was the evening of May 31, 2018 when the woman went to the emergency room of San Martino : very high blood pressure (180 out of 100) and a general condition that was not optimal. She was admitted at 2:45 in the morning but according to the Court's consultants there had been "various negligence" and errors in the diagnosis. "High blood pressure is treated as non-serious gestational hypertension", for example. Furthermore, apart from an ultrasound performed immediately, "there was no monitoring for the unborn child. The woman's neurological signs and symptoms were completely disregarded".
After 8 hours, at 10:45, the doctors of the Gynecology department decided to induce labor. Then the baby was transferred to the hospital in Sassari, where the little one died at 1:00 pm.
According to the consultants, there were "inadequate behaviors, in terms of expertise and prudence, by the health workers of the Gynecology Department of the Oristano hospital for not having promptly diagnosed a picture of severe hypertension that subsequently evolved into convulsive crises" . Furthermore, the doctors would not have complied with "the safety rules for the mother and especially for the fetus, forced to be born in a center that was inadequate from the point of view of neonatal intensive care".
The experts did not find any fault in the neonatologist, who provided the first aid to the baby, nor any responsibility on the part of the cardiologist and anesthetist consultants, who actually contributed to limiting the damages at least to the mother.
