The criminal proceeding is still in its infancy, with the notice of closure of the investigation notified in recent days by the Prosecutor of Cagliari to the governor Christian Solinas, regional councilors, managers and entrepreneurs. But a truth about the matter was written by the Tar of Sardinia: the underground maneuvers - crimes, according to the prosecutor Andrea Vacca who conducted the investigation - had caused a competent professional to lose a selection in favor of one - acceptable to politics , according to the investigators – that he did not have the same abilities. LOBBY AND POLITICS. A broad line of the investigation concerns the pressures linked to the internal selection procedure of the director of the "extraction activities and environmental recovery service" of the regional councilorship for Industry. From hundreds of pages of interceptions, between 2020 and 2021, the lobbing activity of entrepreneurs in the mining sector would emerge, supported by the president of Confindustria Maurizio De Pascale, to "pilot" everything towards the assignment of the task to Nicola Giuliani, a their welcome. The political interlocutor is the councilor Anita Pili. Which in the end does not satisfy them. Because that place is assigned to Gianfranco Porcu, son-in-law of the former president of the Province of Oristano, Pasquale Onida: Pili, for the prosecutor's office, would have sent him the selection questions before the test was held. Accusations still to be proven.

THE EVALUATION. Among the candidates, however, there was also Alessandro Murgia, an engineer, who had held important positions in the Department of the Environment: he is the "foreign body" to the system that breaks the bank. Given the evaluation of the curriculum - which with the oral test would have determined the final score of the selection - he understood that the accounts didn't add up. His career, he was convinced, had been underreported. That of the competitor, however, overestimated, without providing justifications. He immediately let it be known that he would ask for a recount. Some protagonists of the story are alarmed: they say it on the phone, while the investigators record.

THE INVESTIGATION. The interceptions are in the records of the investigation. Like Murgia's appeal and the sentence, which in 2021 overturned the outcome of the selection that was rigged for the judiciary by the will of politics. Reading the device, beyond the outcome of the criminal investigation, it emerges that more than one thing was not regular.

THE APPEAL. We read that Murgia had proposed to the commission (according to the prosecutor composed to favor the competitor) to review his assessment of the qualifications: for years he had played the role of coordinator of a working group on reclamation in the Sulcis mines. An assignment of "high professionalism", which should have earned him many points. The commissioners, having evaluated his request, had defined his activities as simple "overtime work" . His skills, therefore, had been dismissed as good will, which at most could have resulted in a salary increase, but not a step up in the ranking. On the contrary, the competence of the competitor had been rewarded which, according to Murgia, was not "compliant with the provisions of the announcement and would not be relevant to the Service to which the competition refers". The gap between the two was just 1.75 points: both had scored 30 in the oral exam, but Porcu had won the titles.

THE VERDICT. So here is the appeal to the Tar. The verdict arrived in 2021. The administrative judges had established that Murgia, in his curriculum vitae, could boast of having performed «highly qualified special functions both in terms of specialization inherent in the work to be performed, and for the particular role assigned, with additional functions , coordinating the group» when he was involved in the mines of Sulcis Iglesiente. And that this should weigh on the final evaluation, contrary to what was established by the commission.

In the end, Murgia won. And the court will now shed light on the process that led him to prefer Porcu.
