The second-degree trial for the investigation into the escape from Badu 'e Carros prison of Foggia boss Marco Raduano , who escaped on February 24, 2023, ended with an agreement between the parties, which led to a reduction in sentences. The Court of Appeal of Cagliari re-determined the sentences of six of the defendants, accepting the request for a concordat on appeal limited to the sanctions.
The first to choose this path was Antonio Gusinu , defended by the lawyer Francesco Marongiu, obtaining a discount on the first degree sentence.
This choice was also followed by the other defendants, with the exception of Daniele Peron and Marco Rinaldi , who did not renounce their grounds for appeal: Peron's 3-year sentence was confirmed, Rinaldi's 5 years and 4 months, with the replacement of his perpetual ban from holding public office with a temporary five-year ban.
The Court recognized mitigating circumstances for Martino Contu, Antonio Gusinu, Elio Gusinu, Massimiliano Demontis, Marco Furfaro and Tommaso Ruffert , re-determining their sentences.
For Contu , Antonio and Elio Gusinu the sentence increases to 3 years, for Massimiliano Demontis 2 years and 6 months, for Marco Furfaro 2 years and 8 months, Tommaso Ruffert 2 years and 2 months.
The 2-year and 6-month sentence handed down to Marco Raduano, believed to be the head of the Vieste clan, who escaped from Badu 'e Carros prison and is now a cooperating witness, was not appealed.
In the first instance, with the abbreviated procedure, prison officer Salvatore Deledda and Mauro Gusinu were acquitted .
According to the reconstruction of the Cagliari DDA and the investigations of the Nuoro Flying Squad, led by Fabio Di Lella, the escape was made possible by a network of individuals who provided logistical support, cover, and complicity, with the aggravating circumstance of facilitating mafia methods.
The defense team included lawyers Gianluca Aste, Francesco Marongiu, Giuseppe Talanas, Sergio Milia, Giampaolo Murrighile, and Potito Flagella. The trial of Antonio Mangia and Pietro Tolu, the latter a fugitive, remains open before the Court of Nuoro.
