The next 2 February in the Supreme Court could reopen the games in the legal case on the death of Brigitte Pazdernik , the woman of German origin found lifeless in October 2018 in the waters of Su Pallosu . But above all there could be a turning point for Giovanni Perria , the 81-year-old husband of the woman sentenced in the first instance to 24 years for voluntary homicide and in Appeal to 8 years for inducing suicide .

From the verdict of the Court of Assizes of Appeal of Cagliari, which overturned the sentence and charge in November 2021, we start again. That sentence was challenged first by the defense and then by the attorney general .

Defense lawyer Antonello Spada has always supported Perria's innocence, insisting on the hypothesis of suicide, recalling that Brigitte herself had confided to her best friend the intention to end it all. A thesis later accepted by the judges of the Cagliari Court of Assizes of Appeal according to which Brigitte would have entered the water alone but it would have been her husband to take her to the sea that evening of wind and rain of 10 October 2018 , after a heated discussion in the house of Narbolia . But he wouldn't kill her, hence the change in the charge. According to the lawyer Spada, however, this change somehow damaged the right of defense because if one had started with the accusation of instigating suicide, the defensive line would have been different.

The Public Prosecutor's Office, on the other hand, insists on Giovanni Perria's responsibility because, as he had argued in the Chamber , "even being abandoned at sea is a murder" . According to the accusation, the husband is an authoritarian man who had great influence over his wife so as to be able to convince her to enter the water and let herself die in the sea.

It all started from the husband's obsession with a betrayal of his wife (with his brother) dating back to 40 years earlier . And on the night between 10 and 11 October 2018 that rancor would have exploded.

On February 2, the Court of Cassation could reject the two appeals and confirm the sentence of the Court of Assizes of Appeal. Or it could accept the appeal of the defense and demote the proceedings to the Gup phase; another possibility is that the appeal of the Prosecutor's Office will be accepted and at that point the documents will be postponed to the Court of Assizes of Appeal for the redetermination of the sentence for the murder charge. Finally, the Court could rule for an acquittal.
