The Court of Appeal of Sassari will decide next Tuesday which magistrate will have to deal with the Cozzolino murder.

In fact, the judges will have to establish if there are the conditions for the recusal of the Tempio investigating judge called to decide on the position of Davide Iannelli.

The latter is accused of having killed his rival Tony Cozzolino (causing fatal burns to the victim). The facts date back to a year ago and took place in Olbia. Iannelli's defender, the lawyer Abele Cherchi, presented the recusal request, because on the day of the first gup hearing, a request for the calendar of the Court of Assizes was sent from the chancellery of the Court of Tempio. According to Cherchi, it is an anticipation of the decision. Not enough, Cherchi would have also included in his request an act that poses an objective problem. Not only did the Court of Tempio ask for the timetable for the hearings, but the Court of Assizes also communicated a date for the start of the hearing, May 9th.

For Iannelli's defense it is an anticipation of judgement. Thesis not shared by the prosecutor Daniele Rosa and by the civil party lawyers (Antonio Fois, Giampaolo Murrighile and Massimo Perra).
