Two dead and two patients permanently impaired and disabled due to medical errors . With a local Sardinian health company which had ordered payment in favor of the victims of medical errors, but then failed to report the facts to the regional prosecutor's office of the court of accounts, thus preventing the accounting authority from making the damages pay to the doctors. And with the consequence that, as envisaged by the legislation, the company will have to answer for tax damages equal to 2.9 million euros .

This is what emerges from the "Petitum" operation , carried out by the Guardia di Finanza of Cagliari under the direction of the Regional Prosecutor's Office of the Court of Auditors at the Jurisdictional Section for Sardinia, which identified profiles of administrative liability relating to compensation for damages resulting from medical error, the latter confirmed with sentences issued by the Judicial Authority.

In particular, the men of the Fiamme Gialle have carefully examined the copious documentation concerning the health events of four patients hospitalized . The evolution of individual health events had led, in two cases, to permanent impairments and disabilities and in two other cases to death. In some cases the doctors responsible have also been convicted in criminal proceedings .

The consequent legal actions carried out by the relatives of the victims of medical malpractice episodes had led to the condemnation of an island health company to pay compensation due to the serious liability found on the part of the medical teams.

The Local Health Authority, which had ordered the payment in favor of the victims of the medical errors, however then failed to report the facts to the Regional Public Prosecutor's Office of the Court of Auditors , thus preventing the Accounting Authority from proceeding against the medical and healthcare personnel, in the against whom the five-year limitation period has expired for the exercise of the administrative liability action. The legislation provides that, in this case, the person who failed to report is liable for the tax damage .

The tax damage caused was quantified at 2.9 million euros.
