He was not only the protagonist of the book, but he was also its co-author. For this reason, without his explicit consent, the work Matteo Boe: prison, life, freedom could not be published. This was decided by the judge Bruno Malagoli of the Court of Cagliari, accepting the appeal of the former prisoner and ordering the author Laura Secci and the editions "Il Maestrale snc di Podda Giuseppe" to block further marketing, distribution or dissemination of the volume, in any form, even partial.
Against the book, the former prisoner - now a free man after serving his sentence for the kidnapping of Farouk Kassam - had already started a legal dispute before the Court of Nuoro, complaining about the violation of his correspondence and claiming the right to be forgotten. Last year, after a first block of the diffusion, the Nuoro judges had annulled the precautionary measure. This time, Matteo Boe - defended by lawyers Anna Rita Mureddu, Francesca De Abrosis and Francesco Careddu - asked the Court of Cagliari to declare his copyright on the work, therefore also the fact that it could not be published without his express consent. The journalist Laura Secci was assisted by the lawyers Gianni Pinna, Pina Franca Mastroni and Pietro Antonio Sanna, while the publishing house “Il Maestrale” was protected by the lawyer Paolo Raffaele Tuffu.
The genesis and the work was carried out when Matteo Boe was detained under maximum security, with correspondence exchanges with the journalist. But after analyzing all the papers, the judge clarified that "the position of the Boe, in relation to the same literary device of the novel, cannot at all be assimilated to that of a" mere interviewee ", as the resisting parties would claim, having instead to acknowledge the recurring the role of real co-author ". Hence, then, the decision to block the sales of the book. "It must be concluded that the publication censured by the appellant - reads the order - in the absence of his consent, could not legitimately take place".
