The disciplinary section of the CSM sanctioned the Florence prosecutor, Giuseppe Creazzo, with the loss of two months of seniority following the accusations made by his colleague Alessia Sinatra, deputy prosecutor in Palermo, of having sexually harassed her.

The facts date back to 2015, when the two were in a hotel in the capital for work reasons. After that incident the woman had not reported Creazzo, but the whole story had come to light anyway. As? In the midst of the wiretapping of the investigation into the appointments to the top of the judicial offices, some "strange" messages have also sprung up sent by the public prosecutor to his friend and former manager Luca Palamara.

At the time Creazzo was competing for the role of prosecutor of Rome and Sinatra wrote "swear to me that the pig falls immediately" or "my group must not vote for it".

THE PROCEDURE - The general prosecutor of the Cassation at that point decided to see clearly and both the accuser and the accused ended up under disciplinary proceedings. He for having damaged the prestige of the judiciary, she for having sought a sort of moral revenge. According to the indictment, Creazzo would have sought a physical approach with his colleague "in order to insidiously surprise others' reactive defense capabilities". She had not filed a complaint but according to the Attorney General it is a "conduct capable of damaging one's image as a magistrate and the prestige of the entire judiciary".

The college, chaired by the vice-president of the CSM, David Ermini, dropped the complaint of having violated the duties of correctness of a magistrate towards his colleague, believing that the affair can be limited to a fact between private individuals. He thus subtracted from Creazzo's career two months of seniority, while the prosecutor asked for three. For the head of the Florentine prosecutor, “it is - he says - an unjust sentence because I am innocent, it is a decision in accordance with the media condemnation that I had already suffered when the news broke out. I will appeal to the Supreme Court, where I trust that I will finally be able to have justice ".

According to Sinatra's defender, Professor Mario Serio, the sentence is too light and "the impression remains strong and serious that the Italian judiciary and its governing body must continue for a long time on the path of acquiring greater awareness of the value of the dignity of women in the judicial work environment and the adequacy of the relative protection ".

The proceeding against the prosecutor Sinatra is still in progress, the next hearing is set for January 14th.
