Turning point in the trial for the murder of Mario Cerciello Rega.

The Cassation has decided that there will be a bis appeal to reassess the positions of Finnegan Lee Elder and Gabriele Natale Hjorth , accused of the stabbing death of the Carabinieri deputy sergeant, which took place on July 26, 2019 in Rome. The judges annulled the sentence handed down by the Court of Appeal against the two young Americans, sentenced respectively to 24 and 22 years (both had been sentenced to life imprisonment in the first instance). In detail, for Helder the 24-year prison sentence was canceled with postponement on the aggravating circumstances and on the existence of the crime of resisting a public official, while for Hjorth the cancellation with postponement regards the charge of complicity in murder.

«From the first minute in which we examined the trial documents, we understood that Elder had absolutely not understood that he was facing two carabinieri. That surgery was anomalous. In practice there will be a new trial and it is not possible, without reasons, to establish what the new sentence may be", said the lawyer Renato Borzone, lawyer of Lee Elder Finnegan, commenting on the sentence.
