No to the expansion of the Rwm of Domusnovas. This was decided by the Council of State which accepted the appeal for the reform of last year's sentence of the Sardinian TAR which had been presented by Italia Nostra, the Basic Union Union for the Region of Sardinia, Assotziu Consumadoris Sardigna Onlus. Then the procedure for obtaining the authorizations will have to start from scratch and then move on to the environmental impact assessment (Via).

The administrative judges of the second instance annulled the single provision of the municipality of Iglesias which authorized the construction of the new production departments, and the resolution of January 2019 by which the regional council decided not to subject the expansion project of the plant to Via the new test field.

In particular, for the fourth section of the Council of State the subjection to the Via is instead mandatory since "the conclusions reached by the CTU (technical consultant, ed), appointed at first instance, do not allow to exclude unequivocally that the Rwm plant, even if only having regard to the production processes that are the subject of this dispute, constitutes an 'integrated chemical plant for the production of explosives' ". This classification imposes the need for an environmental impact assessment.

The Region was also beaten "which, for the purposes of the investigation relating to the authorization of the test field 140, did not consider that it will be functionally connected to the departments in which the production of explosives takes place".

"The functional connection between the test field and the construction of the new R200 and R2010 departments entails - writes the Council of State - the need to include this intervention in the expansion project to be submitted to a mandatory route".

Satisfaction was expressed by the applicant associations: "We have achieved a great result".
