The deception, yet another, takes place in the month of the harvest. The "sack" of Sardinia's agricultural areas is "hidden" in a decree just converted into law by the Parliament of Rome. An unprecedented mockery in this "cowardly" assault by the State on the Island of the Sun and the Wind. The operation had been studied carefully, completed without any shock, with the complicity of many and the silence of many. The Decree is the usual legislative "train" where you can hook up everything and more.

Kiwi & blue crab

In the beginning it was supposed to deal with agriculture, in the end it became an "omnibus" provision full of incentives for pears and kiwis, interventions to stop the proliferation of Callinectes sapidus, the blue crab, up to the fight against urban "walks" of wild boars across the Tiber . The spotlight, however, was all on article 5 of the «legislative decree of 15 May 2024, n. 63, containing urgent provisions for agricultural, fishing and aquaculture businesses, as well as for businesses of national strategic interest". It is in that device that, first the Government and then the Parliament, deal a very hard blow to the already defenseless land of the Nuraghi. In essence, the Meloni executive, on the proposal of the Minister of Agriculture, Francesco Lollobrigida, had decided to give a "gift" to the national agricultural organizations that were asking to stop the photovoltaic assault on agricultural fields.

The "sack" of Sardinia

No sooner said than done: in the first draft of the Decree the ban on creating panel embankments on agricultural areas was almost total. From the beginning, in the text of the measure passed by Palazzo Chigi, there were, however, two lethal vulnerabilities for the island. The first: the new prohibitions were valid only for projects to be presented after the launch of the new law, while those already presented would have been evaluated with the previous rules. In this case Sardinia would have been "deceived" without too many pleasantries given that most of the photovoltaic and agrivoltaic projects to devastate the island had already been presented some time ago.

Double insult

The second flaw is a double "deception": the State rule which "urbanistically" prohibits photovoltaics in agricultural areas does not apply to the Autonomous Region of Sardinia which has primary jurisdiction precisely in the "urban planning" matter. A double joke: on the one hand the State protects the agricultural areas of the "Continent", falling within the ordinary Regions, on the other the Sardinian Region decides not to use its "urban planning" competence by entrusting the protection of the Sardinian agricultural areas to a pseudo « moratorium" which has already proven to be clearly useless, ineffective and functional only to waste time. A legislative provision approved by the Regional Council on the proposal of the Council which is in fact facilitating all those fixers and speculators who, in the absence of any "ban", not only continue to consume the agricultural devastation with impunity with blows of bulldozers and panels, but persist in flood the offices of Rome, and beyond, with new photovoltaic and agrivoltaic projects, as if there was no end to all this devastation. A provision, the one just launched by Montecitorio, after the passage to Palazzo Madama, which risks putting the island under attack even more, given that the legislative path undertaken by the Sardinian regional council is devastating: in fact, only "areas suitable", knowing full well that the Draghi decree de facto considers "suitable" even those that do not fall among those indicated by the Region. A real substantial and lexical "scam", which will put the entire island in a dead end. On the «areas» explicitly declared «suitable», if one ever has the courage to indicate them, fast and preferential lanes will be applied to approve the projects. On all other areas, however, even if not declared suitable, there will be no "bans" on placing wind turbines or expanses of photovoltaic panels, but "only" ordinary procedures and times for approvals will be provided.

One and a half million hectares

The operation in Rome, with the useless one in Cagliari, seems like a combination capable of leaving over one and a half million hectares of agricultural areas in Sardinia without any protection from the speculative plans that appear day after day in every remotest corner of the Island. On a legislative level, there is in fact a regulatory vacuum, all to the detriment of Sardinia. In Italy, in fact, the installation of photovoltaic systems, with modules placed on the ground, "in areas classified as agricultural by the current urban planning plans" will be prohibited; on the island, however, as the Region has not used its primary competence in "urban planning" matters , we will be able to continue to "plant" steel, silicon and wind turbines galore, without anyone doing anything to prohibit it.

Urban planning expertise

In this matter, the Sardinian Region bears direct responsibility in having deliberately chosen not to approve an "urban planning" law to categorically "prohibit" the assault on agricultural fields, and not only, in Sardinia. A provision of "constitutional" rank provided for in Article 3 letter "f" of the Statute which regulates the primary competence in matters of "urban planning". A step that the Government of Rome did not miss. In the latest draft of the conversion into law of the Decree, it is no coincidence, in fact, that they remembered to add the clause, "due" but lethal, which effectively "discharges" the agricultural areas of Sardinia: «Safeguard clause - 1 The provisions of this decree apply in the Special Statute Regions compatibly with the respective statutes". In other words: given that the Sardinian Statute provides for the "Urban planning" competence of the Region, this state regulation cannot be applied on the island.

Stop the disaster

In Rome, however, they have thought of everything. If the Sardinian Region had the intention of making it its own, as the Palaces of Roman power have written it, it will have to comply with an explicit clause: the ban "does not apply to projects for which, on the date of entry into force of this decree, at least one of the administrative procedures has been initiated, including those of environmental assessment...". Now, also in light of the "urban planning" law adopted by the State for the ordinary Regions, everything is all too clear. Sardinia has only one way to stop the invasion: using its primary competence in the field of "urban planning" to prohibit the invasion, also stopping the projects already presented. Everything else will be complicit in the devastation of the Island, the wheat and the Nuraghi.
