Mirko, killed to defend his mother: the shortened rite for the accused, who risks life imprisonment, is denied

No shortened procedure (which in case of conviction involves the reduction of a third of the sentence) for Masih Shahid, the 30-year-old Pakistani accused of the attempted murder of his ex-partner, Paola Piras, aged 52, and of the murder of Mirko Farci , son 19 year old of the woman, who had tried to defend her mother from the attack that took place on 11 May 2021 in their home in Tortolì .
The 30-year-old was in fact sent to trial, but the trial - with the first hearing scheduled for the end of June - will take place in the Court of Assizes in Cagliari, with the accused thus facing life imprisonment.
Piras, who had remained in a coma for months following Shahid's 17 stab wounds, was present in the courtroom, while the accused was absent.
After an hour in the council chamber, the gup of Lanusei Mariano Arca rejected the issues of constitutional illegitimacy and the request for an abbreviated procedure conditional on the psychiatric report and the hearing of a friend, advanced by Shahid's defender, Federico Delitala.
Instead, the ordinary rite, solicited by the prosecutor and the lawyers of the civil parties, has been arranged, in consideration of the aggravating circumstances, or the premeditation and commission of the crime on the occasion of the mistreatment in the family contested to the 30-year-old.
As for the request for a psychiatric report, the defense pointed out that Shahid has already accused symptoms of psychic imbalances in the past. According to the lawyer, in fact, Paola Piras herself, heard before the trial for mistreatment for which her ex-partner must answer, said that the man suffered from "manic and suicidal manias" and would spontaneously go to a health center mental.
For the allegations of stalking and ill-treatment, in March the prosecutor Giovanna Morra had asked for a sentence of 4 years and 8 months for the accused. The sentence is scheduled for next May 3.
