The Court of Cassation puts an end to the legal case related to the death of Massimo Piroddi , 43 years old, from Bari Sardo . The judges confirmed the sentence formulated by the Appeal judges against Daniel Loi, 23 years old from Bari Sardo, accused of the unintentional homicide of the blacksmith from his countryman, which occurred on the night between 16 and 17 January 2020. The Court rejected the appeal filed by Francesco Serrau, the young man's lawyer, who requested the annulment of the sentence of the Court of Appeal from which he had asked for acquittal "because the fact does not exist or does not constitute a crime". The Attorney General maintained that the appeal was inadmissible.
The Court of Cassation has effectively ratified the framework of the first-instance sentence issued in January 2021 by the Lanusei court. The young man had been recognized as having the mitigating circumstances of provocation and generic ones. Loi had initially been arrested by the Carabinieri, but the investigating judge Giampaolo Piana had not validated the measure because it had not been carried out in flagrante delicto but several hours after the tragic fight with Piroddi.
In the legal proceedings, the family of the missing blacksmith joined the civil action with the lawyers Paolo Pilia and Marzia Graziano. The tragedy occurred at the height of the bonfire of Sant'Antonio. Loi and Piroddi had argued on the steps in front of a bar. At a certain point, the argument degenerated, so much so that Massimo Piroddi lost his balance, flying down the step . He died as a result of severe head trauma.
