Flavio Sensi's appeal to the Sassari Local Health Authority (ASL) has been successful. Another, multiple and extraordinary, is pending before the President of the Republic (the competent court is the Council of State). Two local health authorities, Cagliari and Olbia, are still without a leader (for 50 days). And now another challenge: the former general director of Arnas Brotzu, Agnese Foddis, has filed an appeal with the Regional Administrative Court (TAR) challenging the appointment of Maurizio Marcias as manager of the company that governs Sardinia's most important hospital. Meanwhile, another mystery surrounds the newly appointed administrative director of the Five Star Movement, Antonio Guerrieri: his recently appointed position is not considered secure.

Foddis' appeal

The new healthcare dispute before the Regional Administrative Court was triggered by Agnese Foddis, who hired lawyer Matilde Mura to challenge the appointment of her successor, Maurizio Marcias, to the Brotzu Hospital. The challenge stems from the declaration of unconstitutionality of the law that placed all Sardinian healthcare companies under special administration. That law also formed the basis for the selection process for general directors initiated by the Region in September. With the former being invalidated by the Constitutional Court's ruling, the appeal argues, the legal basis ("the only one") for the latter, which formed the list from which the Regional Council drew its selection process for new general directors, such as Marcias, also disappears. Therefore, the entire procedure is allegedly illegitimate, and Foddis is claiming the position that was unlawfully removed from her: she does not seek compensation, but recognition of her tenure in the position she was given for five years in 2022. The appeal also requests a precautionary measure, which, if granted, would suspend the effectiveness of the resolution of December 31, 2025, which appointed the current director general.

The administrative director

Regarding Guerrieri's appointment, there are currently only rumors: having not held similar roles in the Regional Council for five years, the retired financier is said to be unqualified to lead the administrative side of Arnas. An official version of the matter could only come from the company itself. When asked, it responded: "We are not making any statements."
