The ruling confirmed the decision of the Court of Appeal, which had instead overturned that of the first instance: initially, the use of the "Cacio romano" trademark had been inhibited, with the seizure of the wheels in storage and sold by the " Boccea cheeses” .

Too big differences in the denomination and in the product, these are the reasons of the Cassation, but not only: the brand of the "Cacio Romano", according to what was established by the Supreme court, had already been registered in 1991 , five years before the recognition of the Dop of the " Pecorino romano” by the European Commission, which took place in 1996.
