Three sentences of two years in prison, with conditional suspension of the sentence, for the defendants for the tragic accident at work that cost the life of Claudio Milia, a worker from Iglesias who died at the age of 45 on 13 November 2020 after falling from the roof of a warehouse in the industrial area of Sa Stoia.
Today, Judge Giulia Tronci pronounced the sentence for the trial and convicted the defendants: Gianluca Locci, who is now 48 years old, Giorgio Ciccu, 67 years old, and Gianluca Tocco, 45 years old . The second is from Iglesias, the other two from Villamassargia. In addition, the judge established a provisional payment in favor of the victim's family of 150,000 euros for the wife, 100,000 for both parents and 50,000 for the brother . After the accident at work that cost Milia his life, the Cagliari Prosecutor's Office had opened criminal proceedings for the crime of manslaughter, with the aggravating circumstance of having been committed in violation of accident prevention regulations.
On November 13, 2020, Milia, a carpenter working for the local company Cq Nol Srl, had climbed onto the warehouse of the company Lo.Ci Trasporti Srl to check the roofing in view of some renovation work on the left span of the building, entrusted to the company he worked for. Suddenly, the roof had given way under his weight and Milia had fallen from a height of 4.20 meters: a fall that had caused his death, due to the severity of the trauma, despite immediate assistance .
The family, assisted by Studio3A-Valore and with the collaboration of the lawyer Serra of the Cagliari court, had asked for light to be shed on the tragedy. And, after a long trial, the three defendants were convicted . Locci because, as the request states, «as the owner of the company LO.CI. Trasporti, the client of the works, he did not appoint, before their assignment, the coordinator during the execution phase of the works relating to the inspection to verify the structural integrity of the purlins supporting the left span of the roof of the factory, in which two companies operated at the same time». Ciccu because «as Milia's employer, before proceeding with the execution of the works on the roof, he did not prepare collective protection measures, and since the roof was of dubious resistance, he did not adopt the necessary arrangements to guarantee the safety of the workers, placing boards above the orders and using suitable personal protective equipment against falling».
For Tocco, the trial was requested because, as a worker of the other company involved in the construction site, 2T Società Cooperativa Sociale, «he made a use different from that indicated in the instructions for use and maintenance of the manufacturer of the elevating work platform, used in carrying out the work: the victim had been “landed” on the roof from the basket of the platform driven by Tocco, who however was not authorized to “land”». According to the prosecution, all three defendants contributed to causing Milia's death «with independent negligent conduct and with violation of laws and regulations for the prevention of accidents at work, as well as with negligence and incompetence» .
