"Nullity of the first-instance judgment due to the lack of signature by the drafter." This is the request advanced by the lawyers of Ciro Grillo and his three Genoese friends – Edoardo Capitta, Vittorio Lauria, and Francesco Corsiglia – accused of gang rape and subsequently convicted in the first instance by the Tempio Pausania Court.
On the eve of the start of the appeal trial in Sassari regarding the events reported by a young woman and which allegedly took place in a villa in Porto Cervo in the summer of 2019 , the lawyers of the four filed a document which highlights that the first instance sentence "bears the signature exclusively of the president (Marco Contu) and of only one of the two judges indicated as drafters".
According to the lawyers, "the failure of one of the drafters to sign the judgment constitutes a breach that cannot be downgraded to a mere irregularity, but rather renders the judgment null and void, and must be returned to the Tempio Pausania Court for renewal of the invalid act." The defense is therefore requesting that the judgment be rewritten . Consequently, the start of the appeal process could be postponed.
