A blow to the heart of the oldest Royal Palace, a sentence that risks forever scarring the thousand-year-old Nuragic Civilization of Sardinia.
The Council of State publishes the harshest decision, with a premise that smacks of "tied hands": the Judges have the obligation to rule by applying the laws in force on the date of approval of that nefarious project that aims to place a silicon "grill" of 24 hectares in front of Su Nuraxi.
In this dispute, the Roman magistrates were called upon to accept or reject the appeal of the Municipality of Barumini, supported in the defense by the Sardinian Region. The Council of State, however, could only confirm the first-instance judgment of the TAR Sardinia: appeal rejected.
The ruling, however, despite the rejection of the appeal, leaves an important glimmer of hope. The approval procedure for the project, in fact, is not concluded: in order to begin work, the Single Authorization of the Region is needed . It is at this stage that Viale Trento will have to decide.
