The President of the Order, Carlo Selis, has signed a document explaining the reasons for the lawyers' "strike". It starts with the denied civil justice: "The civil sector presents very serious critical issues, especially related to the length of proceedings and the management of postponements: some roles currently know postponements until well into 2031; some Magistrates deal with the first hearings of the parties up to 3 years after registration on the roll; the times for dissolving reservations assumed or for communicating the results of hearings held in written proceedings can be counted in many months, even years; in many cases oral discussions are repeatedly postponed, often from one year to the next". According to the lawyers, the Court is giving absolute priority to clearing the backlog to the detriment of more recent cases.
Another issue on the table is that of the approximately 1300 unified contributions and stamps that, according to the Court registries, still have to be paid for civil cases that have been open for years . The lawyers are protesting because they claim that the payments have already been made. The problem is that the tax bills (total amount of one and a half million euros) addressed to the lawyers' clients are being sent out. The lawyers believe that in most cases "neither the citizens nor those who assisted them can have such responsibilities as to be forced to pay a second time a tax that they are sure to have already paid, as proven by documentation present in the files of the individual files".
The lawyers believe they must protest "so that the situation in which they find themselves working is brought to the attention of those responsible, so that efficient and shared solutions can be identified, declaring themselves available for any discussion and collaboration".
