The legal consequences of covid. A 50-year-old from the capital of Sassari accused of assaulting a tourist who, in 2020, had refused to wear a mask inside the Alghero market managed by the defendant was acquitted yesterday in court in Sassari. It was July, at the height of the pandemic emergency, and the 48-year-old from northern Italy had entered the premises without protective devices despite the requirements of the time. And when this was pointed out to him , the man allegedly said phrases such as “Covid doesn’t exist. You invented it ,” bickering with both the owner’s sister and the butcher of the establishment. When he reached the cash register, the owner stigmatized the behavior of the tourist who, at that point, according to what was reported in discussion by defense lawyer Gianmarco Mura, violently slammed the products on the shelf, saying “And what will you do if I don’t wear a mask?” and getting closer and closer to the manager. Who, according to the lawyer, finding himself with his back to the wall, would have defended himself with the cash register separator. At that point an impact occurred between the object and the arm of the 48-year-old, causing a fracture of the limb and a prognosis of 30 days.

The civil party's lawyer had asked for 16 thousand euros in damages plus legal costs, the prosecutor a four-month sentence while judge Paolo Bulla pronounced a sentence according to article 530 paragraph 3, which provides for acquittal "if there is proof that the act was committed in the presence of a cause of justification, or a personal cause of non-punishability or there is doubt about the existence of the same".
