Adiconsum Sardinia announces the start of a legal battle against Aeroitalia for failure to comply with the provisions regarding territorial continuity.
The association relaunches the complaint of Fiavet travel agents who accuse the carrier of having changed the rules of the game once the game has started, denying direct refunds to Sardinian passengers who decide to renounce the departures.
«One of the rights recognized to travelers in the context of the territorial continuity service - explains Adiconsum - is precisely that of immediate reimbursement of the travel ticket in case of cancellation of departures, a right that Aeroitalia now seems to want to cancel, opting for the recognition of a voucher that Sardinian users can use within one year".
For the president of the regional consumer association, Giorgio Vargiu , this is «an incorrect practice and not compliant with the provisions of the service contract , which clearly damages Sardinian consumers who on the one hand could decide not to purchase other flights within the 12 months foreseen by the airline, on the other hand they cannot be certain that, after the expiration of the voucher, the money spent for the purchase of unused tickets will be returned to them, as it is impossible to predict the fate of the air carrier in such a long term and above all if the operator will be assigned the territorial continuity service also in the years to come".
Hence Adiconsum's decision to present a complaint to the Antitrust and the Transport Regulatory Authority , «so that they can investigate the matter in light of the possible unfair commercial practice, and a report to the Sardinia Region and the Ministry of Transport, so that they take action to aim of obtaining compliance with the rules by Aeroitalia".
The association has decided to provide legal assistance to all Sardinian users affected by the case.
