The former managing director of FS and Rfi Mauro Moretti was sentenced to 5 years in the appeal process for the Viareggio railway massacre of 29 June 2009, when a freight train with tank cars for the LPG derailed, causing an explosion and a fire that caused 32 deaths .

In the first appeal Moretti had been sentenced to 7 years, in this new trial ordered by the Supreme Court the Attorney General had asked for 6 years and 9 months .

Moretti has not renounced to make use of the prescription differently from the previous degrees of judgment. And by prescription , the Court declared the crime of manslaughter extinct following the indications of the Supreme Court.

Moretti was convicted of negligent railway disaster, fire and negligent injuries . The judges in fact ruled out the fault of the omitted provision of reducing the speed of freight convoys, one of the negligent profiles on which the Supreme Court had asked to evaluate the merits.

" The sentence is very disappointing . A 5-year sentence for a trial without evidence is really a theorem and we can't help but regret it. It betrays an interpretation of this story that is not the real one. We will read the reasons" expected in 90 days " , the comment of Moretti's lawyer, Ambra Giovene , after the reading of the sentence.
