The concession fee paid by TIM in 1998 will have to be repaid by the Italian government, which will therefore have to pay one billion euros.

The Court of Cassation ruled in favor of the appeal to recover the sums paid by the company to the state as a "mandatory contribution." The former telecommunications monopoly has always considered this request illegitimate, and has therefore decided to take legal action.

This ends a long dispute that in 2024 led the State to appeal the ruling of the Rome Court of Appeal that had ruled in favor of the group.

In May, the Italian Supreme Court postponed the final decision on the case to conduct further investigations and determine whether TIM's initial request had been submitted to the competent court.

Today the Court of Cassation has put an end to the matter.
