Two 26-year-old men accused of gang rape against a girl who was 18 at the time of the incident, which occurred in 2018, were sentenced to two years and eight months in prison on appeal in Florence.
In the first instance, the two had been acquitted by the preliminary hearing judge, who in 2023 had deemed them not punishable due to an error on the fact that it constitutes a crime.
In the reasons for that sentence, the judge had argued that the defendants "could not have perceived the girl's no," citing a "highly distorted conception of sex" which, according to the court, had led them into error.
The Florence Court of Appeal overturned the decision, finding the two defendants criminally liable.
The incident reportedly occurred during a party at a home in the province of Florence . According to reports, the alleged young victim was intoxicated. A minor was also implicated in the incident, being tried in a separate proceeding: he had been placed on probation.
