A single proceeding for separation and divorce and first hearing within ninety days.

These are the innovations provided for by the Cartabia reform on divorces which will come into force on March 1, 2023. The goal is to make these practices simpler and faster, significantly shortening the times.

Not only that: a sentence for compensation for damages will be foreseen for the parent or spouse who may possibly conceal their income. Another novelty is that couples with children will have to present a parenting plan with all the activities for minors and a plan for visits ; furthermore , minors will also be heard for the measures that concern them .

According to experts , the problems will arise on how the courts will actually manage to dispose of the workloads . On paper the times are halved but in reality we will have to see "in progress".

“Certainly it won't happen more than just for a separation - says the lawyer of the International Women's House in Rome Domenica Santarcangelo - it will take 12 years as happened for a Roman couple. We are now starting the divorce procedure.' «The children - says Santarcangelo - I see them become adults in the course of the separation. Currently for a separation without particular problems between spouses it takes about 3 years. Let's hope with the new legislation it will arrive in a year and a half ».

Many couples have decided to wait until March to file the application and take advantage of the new regulations. «In my experience, 80% of separations - underlines the lawyer - take place due to domestic violence. So how does the court rule in this case? The reform provides for a particular form of protection with specific paths, but we need to see how the Court intends to organize itself. What are the tools he has put in place?».
