Marco Venturi did not directly kill his girlfriend Carlotta Benusiglio but his death by hanging was caused by his "oppressive behavior".
This is what was established with an abbreviated procedure by the magistrate Raffaella Mascarino who, by condemning Venturi to six years of imprisonment (9 reduced to 6 due to the reduction of the abbreviated one), requalified the accusation of voluntary homicide in death as a consequence of another crime , as well as what injury and stalking.
The woman, 37, was found hanged with a scarf on the night of May 31, 2016 on a tree in the gardens of Piazza Napoli, in Milan . For years, the responsibilities of the 45-year-old boyfriend have been investigated: the man, according to the Prosecutor's Office, had been immortalized by surveillance cameras at the scene of the crime, and that day between the two there was yet another heavy quarrel.
Elements that together with others had prompted the prosecutor Francesca Crupi to ask for a 30-year sentence for voluntary murder , stalking and injuries, which she allegedly committed against her partner between 2014 and 2016. Even the civil lawyers, the lawyers Gian Luigi Tizzoni and Pier Paolo Pieragostini, who represent the designer's mother and sister, have always supported the thesis of murder with simulated suicide , also through technical consultancy.
Judge Mascarino instead established that the death was not caused directly "by the hand" of the boyfriend , so much so that he did not recognize the voluntary murder, but it was a "consequence" of his malicious conduct, probably stalking and injuries (crimes recognized with the judgment). In favor of this thesis, a forensic examination that established that it would be a suicide and a final assessment, ordered by the gup Mascarino, with which a computer expert, after examining a few minutes of footage of one of the cameras in the square, concluded that the dark spot that appears in the video is not a shadow of a human silhouette, hence his own, but an "artifact due to the compression of pixels in the images".
THE REACTIONS - "We are happy because the responsibility for my sister's death has been traced back to Marco Venturi, he was not sentenced to many years but we wanted to restore dignity to my sister and today this thing has been done, I believed in justice and it has arrived ", Giorgia Benusiglio, sister of the designer, commented in tears.
The judge also recognized provisional compensation for Venturi of 200 thousand euros each in favor of the designer's mother and sister. Even the civil lawyers, the lawyers Gian Luigi Tizzoni and Pier Paolo Pieragostini, underlined that with this verdict (motivations in 90 days) "Venturi's responsibility was ascertained" for the death of his partner: "There were therefore some malicious facts by Venturi that led to his death ", said the lawyer Tizzoni.
"The hypothesis of the accusation that Venturi strangled and staged the suicide of Benusiglio has completely fallen away, as far as I can understand from the judge's device whose factual and legal logic escapes me", the words of the lawyer Andrea Belotti who, together with his colleague Veronica Rasoli, he assists Marco Venturi. Venturi, added Belotti, "is disappointed, because a conviction has arrived". What matters, however, he added, "is that no one can dare to call him the killer of 'former partner , this is a point in our favor and we will absolutely appeal ".
A "small satisfaction", for the lawyer, "is that he was acquitted of an episode of injuries, the one in which numerous images of her with swollen eyes were shot on TV". And again: " I trust that he will be acquitted on appeal of all the rest , starting with a juridical requalification for which I am waiting to read carefully the reasons of the judge".
