He had confessed to the investigating magistrate that he had participated in the rape of the 19-year-old girl on 7 July among the sheets of the construction site at the Foro Italico in Palermo. A confession also dictated by incontrovertible video evidence in the hands of the investigators. The judge had revoked his remand in juvenile detention (he came of age a few days after the sexual assault) sending him to a rehabilitation community claiming that the boy had made a "critical review" of his behavior". Now, three days later , the eighteen-year-old accused returns to the Malaspina juvenile penal institution , together with six other young people, aged between 18 and 22, of raping the nineteen-year-old by filming the phases of the violence.

He would have shot a series of videos, posted on Tik Tok, violating the magistrate's prescriptions, in which he boasts of the messages he received from several girls. The young man also put some sentences on the social platform such as "whoever opposes me opposes death".

The careful examination of the messages and comments after the rape written to the other alleged rapists would also have weighed on the new decision of the investigating magistrate Antonina Pardo, who would prove that during the interrogation she would have lied to the judge about her "repentance" and would not have said the truth about the stages of sexual assault.

His statements, writes the investigating judge, «had an absolutely instrumental value aimed solely at obtaining the mitigation of the measure» .

«These new investigative elements - writes Pardo in the provision - outline the personality of a young man who, far from having started a path of awareness of the very serious crime committed, having obtained conditions of greater freedom with inclusion in the community, continued to use the mobile phone or other information device to boast of his deeds and to demonstrate adherence to criminal behavior patterns".
