B&B, the TAR annuls the Viminale rules on visual recognition

«The TAR of Lazio has annulled the circular of the Ministry of the Interior of 18 November 2024 which introduced the obligation of visual recognition of guests of homes rented for short periods».
The announcement was made by Aigab-Associazione Italiana Gestori Affitti Brevi. «We are already in contact with the government to make our know-how available in order to obtain full recognition of the remote recognition technologies used, demonstrating our role in supporting the institutions», adds the president of the association, Marco Celani.
"On the merits - explains Celani - the sentence is based on two arguments: the obligation of identification de visu , interpreted as physically, is in contrast with the reduction of administrative obligations for owners and businesses. Furthermore, public action must follow a principle of proportionality for which in order to introduce operational burdens or limit freedoms it is necessary to support with data the necessity and the capacity of the rule to resolve a documented problem".
The president of Aigab hopes that "the principle of proportionality will inspire the actions of many local public administrations that have abused the circular by introducing regulations that expire today, having in the meantime caused discomfort, costs and worries to hundreds of thousands of families and entrepreneurs".
