The prosecutor of the Court of Appeal of Genoa appealed to the Cassation against the sentence that acquitted Simone Scalamandrè accused, together with his brother Alessio (who had instead been sentenced to 21 years) of killing his abusive father Pasquale in August 2020.

Pasquale had gone to the home of his ex-wife, who was in a protected structure in Sardinia, and to his children to ask to withdraw the lawsuit against him for the mistreatment. An argument ensued which culminated in the murder.

Simone Scalamandrè was convicted in the first instance and acquitted on appeal, but for the substitute pg Cristina Camaiori the motivations of the second instance judges would have been concise and partly contradictory.

The appeal judges - underlines the pg - dedicated only three pages to explaining why the younger boy would have hit his father only lightly and with his bare hands without actively contributing to the murder.

Luca Rinaldi and Andrea Guido, the lawyers of Alessio Scalamandrè, also appealed to the Cassation: according to them, the sentence should be annulled because a psychiatric report was not made and for not having considered legitimate defense or, alternatively, unintentionality. (Unioneonline/lf)
