It has become a case, in the United States, of the appeal filed by a Texas woman against a fine imposed on her by the traffic police because, while alone in the car , she had occupied the lane reserved for car pooling , that is to say the "cars" with two or more people on their way to work.

When she was sanctioned, in fact, Brandy Bottone, 32 , was 34 weeks pregnant and for this reason the woman contested the provision arguing that, given that according to the laws of Texas , fetuses also have the status of "individuals", to use the car pooling lane would not have been a violation .

The diatribe soon ended in court (a hearing is scheduled for July 20) and also in the major American media, both for the particularity of the story and because in the US the debate and controversy are still alive after the sentence with which last June the Supreme Court effectively abolished the right to abortion of American women.

Interviewed by various TV stations, Brandy Bottone explained that there is nothing political in her battle to get the fine ( from $ 275 ) removed, she is simply convinced that she is right .

In Texas and in other US states where the most radical conservatism prevails (for example Alabama), the law that establishes fetuses as individuals has always been "defused" by the 1973 Supreme Court ruling which recognized the right to abortion of women. But with the recent verdict of the Supreme Court itself, these laws could now find full applicability.

So the 32-year-old could get it right? The experts, consulted by the US newspapers, are divided, but in any case the hypothesis prevails that the fine will eventually be confirmed, as the rules in force and above all the traffic code do not consider fetuses as possible passengers of a means of transport.

The laws on the subject, in fact, adopted by local governments in all respects against abortion have so far found application only from a criminal point of view, in cases of crime, where, for example, killing a pregnant woman is was considered an aggravating circumstance precisely in the light of the principle of the fetus already considered as an individual.
