The Sassari Court of Appeal convicted two men from Castelsardo for an alleged very serious sexual assault against two underage girls from Cagliari, which occurred a few years ago. The lower court overturned the acquittal of the Sassari preliminary hearing judge, sentencing the defendants to three years and four months and one year and ten months in prison.
The events occurred in Castelsardo. According to prosecutor Angelo Beccu's reconstruction, the alleged rape victims were escorted to an apartment and subjected to abuse without any opportunity to defend themselves, a situation very similar to gang rape . The preliminary hearing judge, in the first instance, granted the defense's requests (Nino Cuccureddu and Carlo Ermini), acquitting the two accused. Now, the Court of Appeal has upheld prosecutor Angelo Beccu's argument.
The prosecutor had heavily contested an expert report that proved decisive in the acquittal . The report deemed the two girls reliable and in full cognitive capacity, therefore credible in theory, but then, according to the prosecutor, it introduced completely gratuitous considerations about the injured parties, generating a sort of "trial of the woman."
The girls confirmed all the charges before the appeal judges . The requests of the civil parties (Agostinangelo Marras and Paolo Spano) were accepted.
