School downsizing, the Municipality of Oristano appeals to the TAR: «No to mergers»
The mayor: «The resolution that establishes the transition of school directors from four to two does not respect the numerical criteria referring to the school population and is therefore illegitimate. This undermines the right to education."
On school sizing, the Municipality of Oristano appeals to the TAR against the regional school office and against the Sardinia Region.
This was decided by the Sanna Council which mandated the Director of the general affairs sector and the Municipality Secretariat to appoint the lawyer who, in agreement with the organisation's lawyer, will proceed to challenge the sizing documents to request their cancellation or rectification.
« The decision to merge the city's school managements, halving them from four to two, harms the interest of the entire Oristano community , significantly compressing the right to education , constitutionally guaranteed by the articles. 33 and 34 of the Constitution – underlines the mayor Massimiliano Sanna -. In recent months we have repeatedly expressed our opposition to any merger hypothesis. We did this at the provincial conference, in hearings at the Public Education Commission of the Regional Council and during meetings with school authorities, managers and trade union representatives. On every occasion we have rejected the school sizing plan, warning that otherwise we would be ready to protect the rights of Oristano citizens in legal proceedings . Ours is not a preconceived opposition: we contested the method followed, we asked that the decisions be the result of a discussion with the department which never took place or . We asked to leave the situation unchanged, confirming the 2022 Plan and then planning reorganization actions agreed with the mayors, the province and school managements with the Department."
Also on the occasion of the hearing in the Culture and Public Education Commission of the Regional Council Sanna had reiterated the arguments expressed several times by the conference of mayors of the province of Oristano which had translated into a negative opinion on the Guidelines for the planning of the school network and the the training offer for 2024/2025 judged as a regulatory act that impoverishes public schools.
«Today, the same reasons are at the origin of our appeal to the TAR – Sanna further specifies -. We ask for the maintenance of the city's educational institutions , highlighting how the resolution that establishes the merging of the autonomies, bringing the number of school directors from four to two, does not respect the numerical criteria , referring to the school population , established by the same guidelines and proves illegitimate and unjust."
Before the adoption of the resolution of the Regional Council, the mayors of the province of Oristano had sent the Region a document requesting the promotion of initiatives for the protection of the specific characteristics of the Sardinian school , for the establishment of a permanent provincial technical table of education that monitors demographic trends, enrollments and school dropouts and organizes forms of subsidiarity and mutual aid between Oristano and the municipalities of the province, identifies the educational institutions capable of guaranteeing an organizational structure over time in the various levels and levels and the schools which present quality in construction, innovative with laboratories, outdoor spaces, safety parameters and certifications required by law .
The document also asked for a commitment to a regional bill for the regulation of the education and training educational system and a bill for the introduction in Sardinia of the curricular teaching of the Sardinian language in nursery, primary and secondary schools. 1st degree.
