The judge of the ordinary court of Sassari Giovanna Maria Mossa revokes the protective measures for the House of Divine Providence. Yesterday the decision was made which could mark a decisive step for the future of the hospice in via Sant'Anna, which has been struggling for some time between bankruptcy requests, injunctions and recovery plans.
A possibility of rescue was offered by the negotiated settlement of the crisis proposed by the institution, at the end of last year, with the appointment of an expert, Giovanni Pinna Parpaglia, and the application of protective measures, which prevent creditors, says the law , to "initiate or continue executive and precautionary actions on its assets or on the assets and rights with which the business activity is carried out". But the judge rejects the request: first of all because it went well beyond the deadline of the measures, expected to be 140 days to which an extension of a further 100 was also added. What does not convince the judge is the industrial plan presented by the House's lawyers in which, he writes, "the generic nature of the proposal emerges", "without the elements" that attest to "the possibility of divesting the assets" or, for example, that "of acquiring the contributions already allocated". As for negotiations with creditors, it is noted "that there is no indication".
The judge, also with the support of the auxiliary, Alberto Ceresa, analyzes the debt situation of the company and states that "the recovery requires a discontinuity which does not appear feasible on the basis of the proposed plan which limits itself to the sale of the entire company to third parties". And on the proposal by the Sassari Local Health Authority, and its general director Flavio Sensi, to acquire the structure, Dr. Mossa underlines that "there is no resolution from the Local Health Authority in this sense".
In conclusion, in addition to the revocation of the measures, it condemns the appellant to pay the court costs for the creditors and to pay the auxiliary. Meanwhile, the CSA union declares itself satisfied with the sentence: «I trust that the matter, even if it has some negative aspects from a judicial point of view - declares its secretary Giovanni Piras - will nevertheless become positive by comparing ourselves with the bankruptcy trustee and laying the foundations with him for a real and concrete relaunch of the Divine Providence House".
