The discussion between the prosecutor Angelo Beccu and the defense attorneys Raffaele Rocco and Carlotta Pilo focused on the intentionality of the action on which a witness, and partly the injured party, showed some uncertainty. The public prosecutor had also requested to requalify the crime from sexual violence to "harassment" while the civil party, assisted by the lawyer Alberto Manca, had asked for compensation of 10,000 euros.

For the defendant's lawyers, however, the evidence was insufficient and the dynamics of the alleged contact, which occurred in the bar around midnight with several people present, were unclear. Among other things, the man had been removed from the premises after what the employee had said, and not understanding what had happened. The preliminary hearing judge's decision was to acquit the forty-five-year-old because "the fact does not exist" .
