Piras crime, sensational sentence of the Supreme Court: "Process to be redone"
The 24-year sentence for the victim's brother and sister-in-law has been canceled: there will be a new second degree proceeding

A new trial for Nico Piras, 41, and his wife Alice Flore, 38, acquitted in first instance and sentenced on appeal to 24 years each for the murder of the man's brother, Angelo Maria Piras , the breeder of Lula killed in the countryside by a volley of gunfire on 25 January 2015.
This was established by the first criminal section of the Supreme Court, thus annulling the sentence of the Court of Appeal of Sassari and ordering a new second degree proceeding.
The request of the defense board of the accused was therefore accepted: the defenders, Francesco Lai and Tito Flagella for Angela Flore, Angelo Manconi and Giuseppe Madia for Nico Piras, had requested the annulment of the appeal sentence "because he re-proposed a thesis alternative to the first instance sentence, violating the obligation that requires the appellate judge overturning the acquittal sentence of first instance, to draw up a reinforced motivation ".
The Attorney General Luigi Berritteri had instead requested the rejection of the appeal and the confirmation of the second degree sentence associated with the civil parties, Giovanni Colli and Francesco Mossa, representing the wife and children of Angelo Maria Piras.
THE JUDGMENTS - The judges of the Court of Appeal of Sassari believed that "the motive of family disagreements over inheritance issues between the two brothers" was founded "also on the basis" of the last dispute between Nico and Angelo Maria Piras the day before the murder ".
For the Court of Assizes of Nuoro, however, the criminal responsibility of the accused for the crimes ascribed to them had not been "proven beyond any reasonable doubt, since the evidence gathered against them does not unequivocally prove their guilt ", acquitting the two spouses at first instance.
