The Agency for the Protection of Health of the Sardinia Region was sentenced to compensate over one and a half million euros to the family members of the retired carabiniere Paolo Giuliano, 67, who died 9 years ago after a fall in the ward during a radiological examination at the San Francesco hospital in Nuoro.

The criminal trial ended in March last year with acquittal for not having committed the crime of a nurse originally from Dorgali, accused of manslaughter. Now the judge of the civil court of Nuoro, Tiziana Longu, accepting the requests of the wife and children of the deceased soldier, assisted by the lawyer Mauro Intagliata, has ordered the compensation.

The Ats - now Ares - was represented by the lawyer Valentina Antonella Pinna.

The civil action was taken to ascertain the responsibility of the medical and paramedical staff on duty at the San Francesco hospital in the death of their relative, which occurred in June 2014.

"In the present case, as was highlighted on the basis of the advice given by Professor Ernesto d'Aloja and Dr. Luchino Chessa - reads the sentence - it must be considered that the death of Paolo Giuliano is causally attributable to the imprudent and negligent conduct of the health workers , who, despite the predictability and preventability of the pre-syncope and the fall, have not adopted any suitable measures to avoid this event during the execution of the chest x-ray ".

The man just during the exam had fallen, hit his head and died the next day. In the criminal case, the family members had revoked the constitution of a civil party against the nurse before the end of the trial, now the civil sentence has arrived which holds the doctors of the Medicine and Radiology departments responsible for the death.

Each of the relatives, including Paolo Giuliano's wife and children, was thus awarded compensation for the damage, estimated in total at over one million and 500 thousand euros.
