He had already been sentenced to 4 years of imprisonment for possession and disclosure of child pornographic material, but now he will have to serve six years because the judges have continuously recognized him as responsible for sexual violence against a child who was seduced on the internet. Using his daughter's social account, a 56-year-old from Sestu allegedly convinced a little girl to undress and touch herself in front of the webcam.

The decision

The sentence arrived in recent days, read in the courtroom by judge Simone Nespoli, called to preside over the panel of the second criminal section of the Court of Cagliari.

After the investigation, the prosecutor Gilberto Ganassi had asked for the indictment of the 56-year-old, challenging him for remote sexual violence: in other words, he would have lured a girl who had not yet turned 10 and, using her daughter's account, the 'would have convinced her to undress in front of the PC camera and perform sexual acts, guiding her in the actions from a distance. The little girl was convinced that on the other end of the computer there was a girl of her age, but the investigations later ascertained that her father was there.

The accused

Defended by the lawyer Federico Delitala, the 56-year-old worker has always defended himself by denying any wrongdoing. Last year, however, he had already been sentenced to four years in first instance for possession of child pornography, but acquitted of the accusation of having disclosed photos of girls on the web. After the trial, however, the then panel of judges chaired by judge Tiziana Marogna had suspected that the man had chatted with a minor, thus deciding to refer the documents to the Prosecutor's Office for a new dispute. The prosecutor Gilberto Ganassi thus obtained the indictment for solicitation and sexual violence.

The process

The second trial should have been held before the college chaired by judge Giovanni Massidda who, however, was found to be incompatible for having acted as a judge for the preliminary investigations during the investigation. For this reason, colleague Simone Nespoli, flanked by judges Andrea Mereu and Giuseppe Carta, came to preside over the debate. The facts date back to 2 September 2008, when the accused - according to the reconstruction of the Prosecutor's Office - using the "messenger" profile of his daughter, would have contacted an 8-year-old girl at the time. After having blacked out her webcam, she would have started chatting with the little girl pretending to be her peer. Hence the requests to undress and to perform sexual acts. In the end, the judges decided to also convict him for remote sexual violence, inflicting six years in prison in continuation with the previous sentence. In fact, two more years in prison. When the reasons for the sentence are filed, the defender will file an appeal.
