He killed his mother with an axe: the Nuoro prosecutor is asking for 21 years in prison

After an argument, he took an ax and reached his 88-year-old mother who was lying on the bed and hit her on the back of the head with the back of the weapon. Then he called for help.
The woman, after ending up in a coma and subsequently transferred to an RSA in Padru, died two months later following those injuries .
A crime for which, before the Court of Assizes of Nuoro presided by Elena Meloni, alongside Luisa Rosetti, the victim's son, Salvatore Franceschi, 59 year old from Oliena, is accused, confessing to the murder of his mother Luigina Fois , 88 year old, and for which prosecutor Riccardo Belfiori today requested a 21-year prison sentence.
The testimonies and expert reports already collected by the investigators of the Nuoro Flying Squad during the investigation phase immediately entered the trial file. Franceschi was charged with the aggravating circumstances of the crime committed against an ascendant. The investigation began as a domestic incident. But the injuries reported to the back of the head by the mother were not due to the fall as the man had initially said, but to an attack .
It was November 7, 2022 , the woman ended up in intensive care for a long period, then for rehabilitation in an Rsa in Padru, where she died on January 2 due to that attack. For the prosecution, however, not all crimes are the same and in this case the prosecutor argued "Franceschi killed his mother and confessed to it, the generic mitigating factors must be judged equivalent to the contested aggravating circumstances". Hence the request for a 21 year sentence.
Franceschi's defender, the lawyer Pasqualino Moi, asked for the crime to be reclassified from voluntary homicide to manslaughter : «Salvatore Franceschi didn't want to kill - he argued - this is demonstrated by the fact that in his confession he explained that he realized what he was stopping his action and called 118 confessing to the crime."
For the defense in case of confirmation of the current legal qualification, voluntary homicide, he requested that the generic mitigating circumstances prevailing over the contested aggravating circumstances be recognized and that a sentence contained within the minimum foreseen be awarded.
