Absolution for one of the episodes of embezzlement for the former parliamentarian Roberto Capelli and for the former regional councilor and today mayor of Guamaggiore Antonio Cappai (known as Nello) , prescription for the remaining hypotheses of embezzlement for both and for the other defendants Franco Ignazio Sisinnio Cuccu and Sergio Marracini.
This was decided by the judges of the Court of Appeal of Cagliari , accepting the requests of the deputy attorney general Michele Incani and reforming the first instance sentence that had condemned the four former regional councilors of the UDC in the context of the investigation into the funds allocated to the group and which involved about eighty ladies from the XIII and XIV legislatures.
In the first instance, the panel led by judge Tiziana Marogna sentenced Capelli and Marracini to 2 years and 4 months, and Cuccu and Cappai to 2 years and 2 months. The defendants were defended, among others, by the lawyers Guido Manca Bitti, Massimiliano Ravenna and Anna Maria Busia. After a brief deliberation, the Court presided over by Massimo Poddighe (alternately Giovanni Lavena and Alessandro Castello) accepted the requests of the prosecutor Incani and pronounced the sentence: charges largely time-barred for all four and partly dropped by acquittal for Hair and Cappai.
