The Sardinian Region wins the first round at the Council of State on the Energy decree of the Draghi government. A little while ago the judges of Palazzo Spada accepted with an order the request of the lawyers of Viale Trento to suspend the effects of the decree by which the energy policy of Sardinia had been de facto commissioner.

The judges of the second degree of the administrative judgment therefore considered the matter much more complex than the Lazio TAR did, rejecting the appeal presented by the Region.

Now the administrative judges have set the hearing on the merits for 23 February next, a broad term that could reopen the confrontation between the State and the Region on the energy issue.

The Region, set up in court with the regional lawyer led by Mattia Pani and the lawyers Andrea Secchi and Giovanni Parisi, was assisted by an “ad adiuvàndum” appeal by the Municipality of Portoscuso, represented by the lawyer Silvio Pinna.
