«Not having to proceed because the criminal action should not have been started, as it was precluded by the dismissal order of 07/19/2018 and not preceded by the Judge's authorization to reopen the investigations». With this formula, the judge of the Court of Cagliari, Federico Loche, declared the criminal proceedings involving Edoardo Frau, accused of embezzlement from the Porto Luna 1 Condominium in Villasimius, to be extinguished .

The criminal proceedings arose from a complaint received by the deputy prosecutor Ginevra Grilletti who had accused Frau, administrator of the condominium, of having appropriated 164 thousand euros during its management .

In reality it later emerged that there had already been an investigation into those same facts by the Prosecutor's Office which ended with a dismissal five years ago . The fact is that Edoardo Frau had been sent to trial, defended by the lawyers Carlo Fanari and Mario Maffei, before Judge Loche with the heavy accusation of having stolen huge resources from the Villasimius condominium over the years, who was a civil party with the lawyer Aldo Luchi. With respect to the challenge raised at the time by the Prosecutor's Office - as assessed by the judge - the original dismissal provision taken by the investigating judge of Cagliari in 2018 remains as final judgment, through which the Court had deemed that the accusations made against the accused had no criminal relevance , but it would have been, in reality, accounting errors . Not, therefore, of money stolen from the condominium coffers.
