The Assize Court of Appeal of Cagliari has reformed the sentence against Giovanni Perria, 79-year-old from Narbolia who in the first instance was sentenced to 24 years for the voluntary murder of his wife, Brigitte Pazdernik, 77 of German origin. It has now been inflicted on him for 8 years.

For the judges it was not a premeditated crime but a suicide induction.

The woman had disappeared from home on 10 October 2018 and was found lifeless after three days, by the sea.

The autopsy had revealed a death by drowning.

According to the accusation, Perria would have stunned her during a dispute in their home and then thrown into the waters of Su Pallosu. The Court overturned the sentence by also modifying the charge.

The man, defended by the lawyer Antonello Spada, has always professed innocence, saying that he realized that his wife had left the house and that he sought her but without success. According to the deputy prosecutor of Oristano Armando Mammone, the accused allegedly manipulated the odometer and the camera installed on his car to hide the journey from his home to the sea.

"Professionally it is an excellent result - is the comment of the lawyer - now we will read the reasons for the sentence, but it is clear that nothing remains of the reconstruction of the accusation which had hypothesized premeditation and voluntary murder. Instead, the testimonies of the neighbor and those of the daughters, which the judges considered reliable ".

A neighbor had seen the retiree's car come out who, in the new reconstruction of the judges, may have instigated and facilitated the suicidal intent of his wife, accompanying her to the sea. So he wouldn't be the one to kill her. Between pre-trial detention in prison and under house arrest, the elderly person has already served about two years of imprisonment.
